It is a condition of applying to Geek Markets that you read ALL of the terms and conditions written here and put them into practice if accepted to the market.

Please note that priority is given to stallholders that attend the market themselves to trade and those that are not EVERYWHERE in Canberra already.

We owe a huge thanks to our fans for fueling this amazing journey that we are on, and we hope that you’ll continue to party with us in the future.

  1. Once approved, Exhibitors will be sent an invoice with a date of payment. Failure to pay this fee by the due date may result in the Exhibitor losing the opportunity to trade at Geek Markets Canberra, as well as at any future events run by Geek Markets.
  2. Please note that once payment is made and your space is confirmed, there are no refunds if you cancel. There are no transfers or rollover of credit for the next market date. Written notification of non-attendance of an allocated market is required. Please contact us ASAP if for some reason you cannot attend. Please do not say you want to attend a market if you cannot afford to pay your invoice.
  3. An Exhibitor’s space is only guaranteed once payment has been supplied in full. Any additional Tables and Chairs requested after this point will be subject to availability.
  4. Stalls cannot be transferred, sublet, franchised or sold to any other person, nor can they be shared without written approval from management. You do not own space at Geek Markets.
  5. Stalls can be left set up overnight within the market venue. Please remove any valuable items overnight for your peace of mind. While there is 24-hour security, Geek Markets or the venue is not responsible for any items left overnight.
  6. All Exhibitors are to act in the interest of Geek Markets and therefore take no action that will detract from or draw attendees away from the venue.
  7. Tables will be allocated in the order that they are sold.
  8. A forklift and/or palette jack will not be available for Geek Markets.
  9. Neither Geek Markets nor the venue will accept responsibility for the safety or well-being of any display or product item delivered to the site. It is very important that all items are clearly marked with your company name and table number(s).
  10. Neither Geek Markets nor the venue will take delivery of such items on behalf of an Exhibitor unless prior arrangements have been made. Please note that all goods and property must be removed from the premises Saturday evening.
  11. If items being sold by a Vendor have been tampered with (ie special/hologram cards removed from TCG packs, only 2 figures from a 3-figure set, or pre-opened blind boxes) this MUST be made clear to potential buyers. Failure to do so may see you barred from trading at future Geek Markets events.
  12. No early pack-up is ever permitted – there are no prizes for the first person packed up.
  13. Items or artworks considered to be explicit or containing ‘Not Safe For Work’ (NSFW) content including nudity, sexual content, and/or excessive gore/violence, may be sold at Geek Markets. However, these items cannot be publicly displayed during the festival. These items must be kept in a closed folder or display book out of plain view of general attendees until requested by a potential buyer for view.
  14. Carding of buyers before purchases are the responsibility of Exhibitors, and Geek Markets will not be held accountable for the sale of this content to underage buyers.
  15. All Exhibitors must ensure that their displays do not obstruct the flow of traffic around or through their allocated space. Displays must be removed or relocated upon request by Geek Markets Canberra or the venue staff. Equipment such as display boards or clothing racks may be brought in by the Vendor.
  16. Stallholders are responsible for leaving their site and surrounding area clean & tidy. Boxes & cartons must be removed from market area. Please do NOT use market bins – industrial bins are located near the loading dock for packaging etc. (not your lunch or a coffee cup). We have significant numbers at the market and the bins are only just big enough for general rubbish. If you are found to be leaving other rubbish you will be sent a clean-up bill & not be offered another spot at Geek Markets.
  17. Any damage caused by the Exhibitor, their Staff, or by items affixed to the venue doors, glass, floors, or walls that will create a removal, cleaning and/or resurfacing cost will be charged to the Exhibitor.
  18. Any stallholder found confronting another stallholder for any reason will not be invited back. We do not tolerate this type of behaviour at Geek Markets
  19. All portable equipment, appliances, chargers, or the lighting used at Geek Markets (i.e.: anything that is plugged into the venue power supply) must be tested and tagged in accordance with state Workplace Health and Safety Regulations and Australian Standard 3760-2000. All power extension leads and power boards must also hold current tagging. The use of double adaptors is prohibited at Geek Markets at all times.
  20. Arrangements must be made with your nominated electrician for the purpose of testing and tagging all electrical items and leads. Any Test & Tag conducted by Geek Markets’ contracted electrician during bump-in will incur a cost of $100 per item, which will be billed directly to the Exhibitor at the conclusion of the event. Any electrical equipment found to be untagged must be tested and tagged or removed from the venue immediately.
  21. To the maximum extent permitted, Geek Markets does not accept (and will not have) any liability to the Exhibitor for costs, losses or damages which might be suffered by the Exhibitor or by any other person through participation in the festival and hereby releases Geek Markets from and against all claims, demands, actions, damages, costs, charges and expenses or other liabilities whatsoever that may be made, brought against, suffered, sustained or incurred by the Exhibitor arising out of or in connection with the Exhibitor’s participation in the festival in accordance with these Terms and Conditions.
  22. The display and sale of any Prohibited and/ or Restricted material must comply with the relevant ACT legislation. The following items are not permitted within the venue for either display or sale purposes:
  • Items deemed weapons under ACT legislation.
  • Bootleg items or material violating copyright laws (Fan Art* is allowed at Geek Markets events).
  • Substances and Devices are illegal under Commonwealth legislation.
  • Food or beverages of any kind, unless preapproved by Geek Markets.
  1. Any Exhibitor in possession of these items will be asked to have them removed from the premises. In serious occurrences, Geek Markets reserves the right to have the exhibitor ejected from the venue and banned from future Geek Markets events.
  2. It is the responsibility of the stallholder to ensure they conform to any Australian standards, ACCC, pertaining to their product. Geek Markets will not be held accountable for any trademark, copyright or safety infringement.
  3. Loud product promotion by stallholders is not permitted but dancing and interpretive dance is!
  4. The stallholder must have read and understood the mandatory safety standards applicable to their products and labelling. You can check this at http://www.accc.gov.au
  5. Geek Markets accepts no responsibility for damages to persons or goods, but we will be sympathetic and may provide a band-aid if needed.
  6. Geek Markets has the right to withdraw an offer to trade at any time. Geek Markets does not accept any responsibility for costs incurred.
  7. Geek Markets has the right to reject any stallholder whom they believe does not comply with the stated regulations above.
  8. No amendment or variation to this Agreement will be binding on the parties unless made in writing and signed by each of the parties.

 

*Fan Art is defined by Geek Markets as the following: Fan art generally refers to a creation derived from the official original content, but is not claiming to be officially endorsed by the rights holder or could be mistaken for the original content. In addition to this, there can be no use of licensed logos in these creations. Recolouring or tracing of official art is not considered Fan Art and cannot be sold at Geek Markets
